These Terms and Conditions ("Agreement", "Terms") constitute a legally binding agreement between you (whether an individual shipper, retail consumer, or corporate merchant organization, hereinafter referred to as "Customer", "Shipper", or "You") and CTC Cargo (operating under CTC Cargo Logistics, hereinafter referred to as "CTC Cargo", "Company", "We", or "Us").

By accessing our website (www.ctccargo.co.in), creating an account, integrating our logistics APIs, or surrendering any parcel/freight to our personnel, you acknowledge that you have read, understood, and agreed to be bound by these Terms, along with our Shipping Policy, Privacy Policy, and Cancellation & Refund Policy.

1. Scope of Logistics & Cargo Services

• Commercial Service Definition: CTC Cargo functions as a technology-enabled multimodal logistics provider and licensed freight forwarder, offering domestic surface linehaul, air express courier forwarding, international cross-border cargo transportation, warehousing sortation, and last-mile delivery.
• Non-Common Carrier Status: CTC Cargo is not a common carrier and reserves the absolute right, at its sole discretion, to refuse carriage or transportation of any package, container, or goods without stating reasons.
• Air Waybill (AWB) Contract: Every parcel tendered for transport is covered by a standard electronic or printed Air Waybill. The AWB represents prima facie evidence of receipt of goods and contract of carriage between the parties.

2. Pricing, Freight Tariffs & Payment Terms

• Currency & Quotations: All freight tariffs, courier rates, packaging surcharges, and COD handling fees on our platform are quoted in Indian National Rupees (INR / ₹).
• Applicable Taxes (GST): In accordance with the Goods and Services Tax laws of India, statutory GST at the rate of 18% (or prevailing statutory rate) is applied to all transport invoices. Tax invoices are issued electronically with GST input credit particulars for verified corporate accounts.
• Chargeable Weight Re-weighing: Rates are estimated based on dimensions and weight declared during online booking. CTC Cargo conducts automated weighbridge and laser volumetric scans at primary origin hubs. In the event of weight discrepancy, the customer agrees that the audited chargeable weight recorded at our automated sortation hub shall govern the final invoice, and any tariff shortfall will be debited to the customer's account.
• Payment Instruments Supported: We accept online payments via RBI-authorized payment gateways supporting Credit Cards, Debit Cards, Netbanking (all major Indian banks), Unified Payments Interface (UPI - GPay, PhonePe, Paytm, BHIM), and approved Corporate Prepaid Credit Wallets.
• Advance Payment Obligation: Retail bookings must be paid in full prior to origin dispatch. Registered corporate merchants operate under designated pre-funded wallet credits or bilateral credit agreements.

3. Shipper Obligations, Declarations & Packaging

The consignor warrants and covenants that:

• Accurate Declarations: All particulars relating to package contents, recipient name, delivery address, postal PIN code, telephone number, and commercial value stated on the consignment note are completely true, correct, and legally compliant.
• Packaging Standards: The sender is solely responsible for ensuring proper interior cushioning, sealing, and exterior packaging appropriate for the nature of the merchandise. CTC Cargo disclaims liability for transit damage resulting from inadequate, fragile, or defective packaging.
• Customs & Regulatory Documentation: For commercial goods and cross-border international air cargo, the shipper must provide valid statutory documents, including GST e-Way bills, Commercial Invoices, Packing Lists, KYC proofs (Aadhaar/PAN/Passport), and Importer Exporter Code (IEC).

4. Prohibited, Dangerous & Restricted Goods

In accordance with the Indian Post Office Act, Aircraft (Carriage of Dangerous Goods) Rules, IATA Dangerous Goods Regulations, and Indian penal statutes, the carriage of the following articles is strictly prohibited across our network:

5. Limitation of Liability & Transit Claims

• Standard Liability Cap: Subject to statutory limits under the Carriage by Road Act, 2007 and Carriage by Air Act, 1972, the total liability of CTC Cargo for any verified loss, non-delivery, or physical damage to a shipment is capped at the declared consignment invoice value or a maximum of ₹2,000 (Two Thousand Indian Rupees) per shipment, whichever is lesser, unless the customer has purchased secondary full-value transit protection.
• Exclusion of Consequential Damages: Under no circumstances shall CTC Cargo, its directors, officers, or logistics partners be liable for any indirect, special, incidental, punitive, or consequential losses, including lost profits, commercial opportunity, business reputation, or production downtime.
• Filing Claims Window: Any claim for loss, shortfall, or damage must be lodged in writing with our claims department within seven (7) calendar days from the delivery date (or scheduled delivery date in case of total non-delivery). Claims filed after 7 days shall be deemed waived and time-barred.

6. Force Majeure

CTC Cargo shall be excused from performance and shall incur no liability for delays or delivery defaults resulting from causes beyond reasonable anticipation or control, including acts of God, flood, severe weather, storm, earthquake, war, military actions, terrorism, highway closures, strikes, airline disruptions, cyber-attacks, or customs embargoes.

7. Intellectual Property & Portal Access

All proprietary trademarks, commercial service marks, logos, user interface designs, tracking software algorithms, API documentation, and digital content published on ctccargo.co.in are the exclusive property of CTC Cargo Logistics. Unauthorized copying, reverse-engineering, automated data scraping, or framing of our web systems is strictly prohibited.

8. Governing Law & Dispute Jurisdiction

This Agreement and all contracts of carriage entered into with CTC Cargo shall be governed by, interpreted, and construed exclusively in accordance with the laws of the Republic of India. Any legal action, suit, arbitration, or proceeding arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the competent courts located in Gautam Buddha Nagar (Noida) / New Delhi, India.
